 What is Delta-8 THC?

Delta-8 THC is an organic compound, derived from hemp. It is structurally similar to Delta-9 THC, which is the primary psychoactive compound found in marijuana and was originally believed to be responsible for the "high" associated with its use. Although similar to D9, D8 THC is slightly less potent. It is legally enjoyed by millions due to the reported euphoric, tranquil state, and minimal health risks.

How does it compare to Delta-9 THC?

Is Delta-8 THC Legal?

Short answer: Yes, in most places

H.R. 2: The Agricultural Improvement Act of 2018, commonly known as the 2018 Farm Bill officially legalized the growth and sale of Hemp and all of its derivatives. This definition includes "any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis."

D8 THC is legal in the states whose hemp laws mirror H.R. 2. However, some states have more stringent regulations that do not allow Delta 8. Furthermore, some states have moved to specifically exclude D8 THC from protection.
